Only because they know that the claimed grounds are not defined at law, other than the BMB decision which was tested on lands that dry to a significant margin in Gulf waters. That decision is not readily transferable to more defined coastal regions where little to no drying occurs in the intertidal zones. Other than a blanket 2km zone being declared, there is no possibility of successful enforcement of the BMB rule territory wide.
