I try to see whats behind any proposed changes and I just cant see what their motive is for this one.
Maybe they are just putting out the feelers to see the response.

Me personally dont drink a great deal on the water but if these coppers do have the freedom to test on the water as opposed to on the land as spoken about then it makes it really difficult to ascertain how many cans will tip you over .05, also are they going to wait to test you like they do in your car if you say you have only just finished a drink?,to many murky areas to be successful. As stated the crime rates by the young locals is what needs to be addressed, not the odd coldie out on the water I will be writing to Natasha Fyles to state my concerns.

Hypothetically have a few cans at mouth of tommycut and get breathoed and go over, now what hapeens, ps my deckie has been drinking more than me and cant safely handle a boat so leaving him alone is not an option.
Do the police tow us back to boatramp!
Oh I forgot to mention I demand a blood test!
unless it is testing at ramp only it will be so unenforceable its ridiculous.

like I said before, its totally unenforceable unless the cops get heaps more resources
I can see the issue but cant see it ever working.
just on the test at the mouth, it would be the same as when someone blows over in the street. they dont tow your car or give you a taxi ride home . same would apply here.
remember that when you go over roadside, they take you to the station or unit to do THE test. cant imaging that happening.
people are just getting worked up over a non event. its unenforcable

The strength of the legislation will become apparent in the case of an accident.
A person who's blood alcohol is over .05 and is in control of a vessel that is involved in an accident will have no where to hide.
This is the teeth of the incoming law and one that we should all think about.

I think that is the obvious, although that is done now in the event of a major accident.

I would think that that is obvious, drunk at the wheel of a boat, u don't deserve to have insurance coverage

Your insurance contract will state that if you are under the influence of alcohol at the time of your accident,your policy will be null in void

This might be unpopular but... I see the need for a limit, there has to be a line because frankly the majority of people have poor judgement and eventually do something really dumb. But maybe .08 or even .10 is a more realistic on the water limit. At these levels, you have gone beyond enjoying a few and are getting belligerent and probably should not be the skipper.
Now, maybe the law doesn't need to be enforced. You will probably find that you can carry on as you always have, drink a few tinnies and never feel the wrath of the law. But if the police are on the water and you are carrying on like a twat they might pull the breatho on you. And if it turns out that you are over and being irresponsible (come guys, we have all seen a few questionable acts that should be pulled up) then you should expect to be charged.
Or more to the point... If you have an accident like the one that happened last year at the Finniss, you will be breath tested as he was. He passed the breath and that wasn't the "cause" of the accident. Had he been over a DUI wouldn't have stuck and maybe that would have been less than what the community standards expect. However, next time something happens and they are breath tested and they blow over, you could expect that person to be charged. In my opinion that is pretty reasonable.
