It will be a 90 percent fault attribution to the ship and 10 percent to the fisherman at a guess. The big thing would be........was there an attempt to radio the big vessel early enough to warn of danger of collision. If not they will then say that an appropriate watch wasnt kept by the small vessel at anchor. As there is no boat licencing and it is not a commercial vessel i doubt they will be able to bring the vessel not under comand signals or lights into play for the fishing boat as it was broken down and unable to move i assume. The master of the ship is in a bit of poo and so will the person who should have been on watch.

In a statement released today, Shorebarge Managing Director Arthur Hamilton said the crew of the MV Jane Virgo was feeling distressed following the accident.
“They saw nothing in the path of the barge even though the ship’s master was on watch during the time frame of the incident,” he said.
“The first they became aware of the incident was when they received a distress call from the men who had been on the other vessel.
“The Jane Virgo remained in the area to relay message between the men and the Darwin Harbour Pilot until the pilot stood them down and they continued on their way.”

And from all reports it was the master who was on watch at the time. I think it would be also unrealistic to expect that a recreational fishing vessel even of this size would be required to display lights or shapes indicating restricted in their ability to manoeuvre but no doubt like you said there will be some proportion of blame to save face for the commercial industry. With no licensing requirements in the NT you can hardly expect anyone at anchor at night to even display an all round white anchor light or safely pass port/port.

I thought the 8m was a commercial boat given the size and number of esky's in the photo in NT News. It makes more sense now if it was a rec boat, but surely the master of a 45 metre barge would have radar, series 1 eyeball and radio. I would be surprised if the rec boat would wear any of the blame, particularly if they had seen it coming and tried to radio. The report says it was disabled, so may not have had any power for the radio. No doubt all will come out in time. Its a great result that they all were saved.

By now I'm sure that everyone would have tried to think of what you would do if you were in the same situation.
I always have my grab bag with epirb, flares, safety vest et nearby and ready to go. But im not sure if I would have time to set off a flare. And what was the point if they weren't keeping watch

I nearly hit two clowns in Bynoe weekend before last, one I was going flat out and they put their lights on at the last minute. I had to swerve, the other fools just sat there as I travelled slowly to sound out a reef and I missed them by only a few feet. I guess these rabbits are either ignorant of the rules, or think that by staying dark i wont go over and steal their marks.... My boat is lit up like Marrara Stadium with a light over the console, light over the baitboard, and the all-round anchor light.

A FEW FACTS,,,
I set out at 1830 sat with some tools for a minor repair .
I spoke with them at 1840 to re confirm their position, all OK.
They were about 2 km east of Charles with all round anchor light and all deck and cabin lights on.
I arrived at CP around 1950 to find no sign of them , phone and radio calls got no response.
FARK !!!!
I checked rate of drift and started my search ,stopping several times to listen.
Found them around 20.00 hrs.
Put out a PAN .PAN call and The Jane Virgo responded and got onto the Lameroo ( Pilot boat )
Very overloaded with 6 on board meet up with the Lameroo and transferred the lads to be taken in.

All I can say Jeff is that those lads were lucky to have an experienced mariner like yourself looking for them... A lot of boat owners don't know the first thing about conducting search and rescue, and taking things like wind/tide drift into account. I take my hat off to you, you are a legend!

The Master of the commercial vessel needs to lose his licence!
As a former sailor I spent countless hours on watch on the bridge of vessels much larger than the barge in question and we were able to navigate congested sea lanes like the Sth China Sea, Malacca Strait etc etc with never hitting one of the literally thousands of small fishing vessels. If the vessel at anchor did indeed have its anchor lights on then there is only one reason the barge hit it and that is no one was keeping a proper bridge watch...simple....those barges don't steam that fast so there would have been plenty of time to pick up the vessel....if someone was looking!

Without licencing and therefore proper training, many people may simply be not aware of their lawful requirements. Unfortunately being aware will never replace stupid or ignorant. I have a boat licence from another state. I needed to study a handbook and then perform a written exam to gain it. It cost me between 10 and 20 bucks, and I have it for life. Surely thats not too much for people to have to deal with up here? The more I go out, the more I realise some kind of licencing and training is needed.
Those clowns who will whinge about their territory lifestyle being impeded, well they wont have one to worry about it when my 6 metre plate boat slaps into their unlit 3.7m tinny at 20 knots.
