They have a good point. Fisheries gave out detailed gps marks for the other closure areas off Charles pt and the tiwis.

I wonder what us tax payers paid in leagle fees, police costs etc. They did it to warn us but it backfired

Their argument was that there is a 5 km difference between different publications, yet they were caught 8 km inside the cut off.
And $100, they would have spent more on fuel that day. Seems crazy cheap.

Two of the three fisherman caught fished the Barra Nationals last year and their excuse was that they weren't sure where the closure exists?!?

People get off parking and traffic fines everyday because there are conflicting signs. the govt needs to get it right before they can enforce any laws.

Agree with Nomad.

Potential offenders know the shortcomings of the laws and take advantage.

That's why every now and again the prosecution loses a case (not deliberately but proceeds anyway knowing that its a weak case) with the hoped for outcome of getting the law fixed.

In the NT all fisheries offences are "regulatory offences" so the dice is loaded in favour of the prosecution. Magistrate has to find offenders guilty but can play around with the penalty to send such a message to the Minister.

Looks that way to me in this case. Fisheries will be having another look at signage obligations now in the light of the mitigating circumstances the offenders raised and the magistrate's comments.

Every time someone fights a case and wins because the authority/s cocked up, they either change the law or make things right. Eg there is an ex traffic cop in nsw who fights cases for people and wins because he knows the law and knows that the signs etc aren’t as per the regs.
If the was no sign or it was overgrown etc (I have no idea what they used as a defence) then that’s the fault of the authorities not the fisho who went up there.
I bet the fisheries who have egg on their faces now take steps to fix the problem. Ie make everyone aware of the gps points, erect proper signs etc etc. if they don’t, the judge will give them (fisheries) a big serve if they try it on again
Having said that, the fishos would have more than likely been aware what they were doing was wrong but the fisheries couldn’t prove it.

Why bother closing it, might as well open it up like shady camp, so they can kill all the breeders down the Daly as well.
