Interesting news in the lead up to this weekend's planned protest. Federal Envrionment Minisnter, Tony Burke, told breakfast this morning he's highly unlikely to accept a push by environmentalists for nine marine sanctuaries off the Northern Territory coast.
"I can't see myself going there. I'll read what's put to me. It's a consultation period and I've got to respect that. But if you want a reasonable indication of where I'm headed, look at the draft. There can be some tweaking of those things, but I would be amazed if we end up with a massive departure of what we put out as a draft."
"There is room to provide more environmental protection for our oceans than we have in the past. But a lot of people go out and have great weekends on tinnies out there fishing and I am very relaxed about them continuing to do that."

So with the introduction of fed laws relating to a fed minister being able to overrule territory laws, doesnt that mean that they can only introduce new zones in Federal waters and dont have any sway over NT waters?

Maybe TB sneaks the odd fishin' trip in..might be good to get him up here and take him for a fish..Nothing like a bit of first hand experience of the way things are done up here to put this farce away for good.

The "new" law u're referring to is a Bill which has passed the lower house. It has yet to get through the Senate. Yhe amendment is courtesy of that wonderful pollie "Brown-Nose Bob".
The power to over-rule Territory laws has always rested formally with the Minister for Territories. Cabinet was usually involved in guiding the Ministers views.
The proposed change is to have the Parliament decide on over-ruling a piece of Territory legislation not just the Minister. Both Houses debate the issue. Its basically a diminution of the minister's powers.
To most pollies, when Territory is mentioned their first thought is Aus Capital Territory (ACT) and not NT. There are lots and lots of academic wankers and layabouts in ACT that ole Bob would like to see supporting the Greens (most probably already do).
Although the Constitution of Aus Act prevents the Fed Govt from legislating unilateraly in waters within the 3 nm limits (that wont change) , the Territories Act gives it the power to over-rule any territory legislation.
My view is that if the Constitution prevents the Feds legislating then it follows that the Feds can't un-legislate. either. Therefore there is conflict between the 2 fed Acts and the Territories Act is invalid as far as the over-rule ability anyway.
Would have been a whole lot easier if the NT had started the process to become a State when it had the opportunity at the NT referendum a few years ago.
